Privacy Policy
Last updated: [OWNER TO CONFIRM: date of publication]
The short version: we collect what you send us so we can help you, we keep it secure, and we never sell it or hand it to funders, lenders or lead buyers. The longer version is below, in plain English.
Pre-launch notice — template pending attorney review
This Privacy Policy is a plain-English template prepared for The MCA Rescue. It has not been reviewed by counsel, it is not legal advice, and it is not yet finished. Every highlighted bracket on this page marks a fact only the owner can supply — legal entity name, mailing address, retention periods, vendors and which state privacy statutes apply.
Do not publish this page until a qualified attorney licensed in the relevant jurisdiction has reviewed and approved it, and until no highlighted brackets remain.
Who we are
This site is operated by [OWNER TO CONFIRM: full legal entity name], doing business as The MCA Rescue ("we", "us", "our"), located at [OWNER TO CONFIRM: business mailing address]. You can reach us at info@themcarescue.com or (555) 010-0199. This policy explains what we collect through themcarescue.com, why, and what you can do about it.
What we collect
Information you give us
- Contact details you enter in our forms: name, business name, email address, and phone number if you choose to provide it.
- Business information you enter: industry, number of advance positions, approximate balances, payment amounts, revenue range, urgency, and anything you write in the message field.
- Documents you send us, whether by email or another channel — bank statements, funding agreements, notices and correspondence.
- Anything you tell us during calls, texts or emails.
Information collected automatically
- Standard server log data recorded by our hosting provider, which may include IP address, browser type, referring page, and timestamps.
- [OWNER TO CONFIRM: whether any analytics tool is in use. If none, state "We do not use analytics or advertising trackers on this site." If one is used, name it, state what it collects, and describe the opt-in or opt-out mechanism.]
What we do not collect
- We never ask for and never want your online banking credentials, passwords, or account login information.
- We do not request your Social Security number or date of birth through this website's forms.
- We do not run a credit check based on a website submission, and no form on this site initiates a credit inquiry.
The calculator
The MCA true-cost calculator on this site runs entirely in your browser. The maths happens on your own device, there is no form submission behind it, and we never receive a copy of the numbers you enter or attach them to your name, your email address or an account.
By default your figures never leave the page you typed them on. They are not written into the web address as you type, so nothing is carried into your browser history, and nothing about them reaches our hosting provider.
There is one exception, and it only happens if you ask for it. The calculator has a "Copy a shareable link" button, for people who want to bookmark a run or send it to a bookkeeper or accountant. Press it and your entries are written into the page’s web address. From that point the normal rules for web addresses apply: that address is kept in your browser’s history, where it can later surface as an address-bar suggestion — including on a computer you share with someone else — and if you reload or open that link, the figures travel with the request to our hosting provider and can appear in the standard server log data described in the section above, alongside your IP address.
If you have pressed it and would rather not leave that behind: the "Clear and start over" link loads a clean address with no figures in it, and you can delete the earlier page from your browser history. Using the calculator in a private or incognito window avoids the history entry altogether.
How we use your information
- To respond to your inquiry and give you the free position review you requested.
- To assess whether we can help you, and to tell you honestly if we cannot.
- To perform our services if you become a client, including communicating with your funders on your behalf under a written agreement.
- To send you service-related messages about your file.
- To keep records we are required to keep, and to defend or establish legal claims if that ever becomes necessary.
- To improve how this site works and how clearly we explain things.
We use your phone number to call or text you only if you checked the consent box on our form or otherwise gave us express permission. You can withdraw that permission at any time by replying STOP to a text, telling us on a call, or emailing info@themcarescue.com — and withdrawing it does not affect our ability to help you by email.
Who we share it with
We do not sell your personal information. We do not rent it, trade it, or share it with funders, lenders, brokers, ISOs, lead buyers or marketing companies. Ever. That is the entire point of this section.
We share information only in these limited situations:
- Your funders and creditors, when you are a client and you have authorized us in writing to communicate with them on your behalf — and only what is necessary for that negotiation.
- Service providers who operate our business, such as email hosting, website hosting, secure file storage and scheduling tools. They may process your information only to provide services to us, under contract, and may not use it for their own purposes. [OWNER TO CONFIRM: list the actual vendors in use.]
- Professionals you ask us to coordinate with, such as your attorney or accountant, at your direction.
- When the law requires it, including in response to a valid subpoena, court order, or lawful government request.
- To protect rights and safety, where we reasonably believe disclosure is necessary to prevent fraud, enforce our agreements, or protect someone from harm.
- In a business transfer, if our business is sold or merged, in which case your information would move with it and remain subject to a policy at least as protective as this one.
How we protect it
We use commercially reasonable administrative, technical and physical safeguards to protect the information you send us, including encrypted transmission of this website, access controls, and limiting access to people who need it to do the work. [OWNER TO CONFIRM: describe any additional safeguards actually in place, such as encrypted document storage or a secure client portal.]
We have to be honest about the limit here: no method of transmission over the internet and no method of electronic storage is completely secure. We protect your information carefully, and we cannot guarantee absolute security. If you are sending us highly sensitive documents, ask us about [OWNER TO CONFIRM: secure upload method, if one is offered].
How long we keep it
- If you inquire and do not become a client, we retain your inquiry and any documents you sent for [OWNER TO CONFIRM: retention period for non-client inquiries], after which they are deleted. You can ask us to delete them sooner and we will.
- If you become a client, we retain your file for [OWNER TO CONFIRM: client file retention period, in years] after your engagement ends, in line with [OWNER TO CONFIRM: applicable recordkeeping obligations].
- Server logs are retained for [OWNER TO CONFIRM: log retention period, typically set by the hosting provider].
- Records we are legally required to keep are retained for the required period regardless of a deletion request.
Your choices and rights
- Access — ask us what information about you we hold.
- Correction — ask us to fix anything inaccurate.
- Deletion — ask us to delete your information, subject to records we must keep by law.
- Withdraw phone consent — reply STOP to any text, tell us on a call, or email us.
- Opt out of non-essential email — every non-service email includes an unsubscribe link.
To exercise any of these, email info@themcarescue.com or call (555) 010-0199. We will respond within [OWNER TO CONFIRM: response window, e.g. 30 days] and we may need to verify your identity first.
Owner input required: state privacy laws
[OWNER TO CONFIRM: whether additional state-specific rights apply to your business and clients — for example California, Colorado, Connecticut, Virginia or other state privacy laws — and add the required disclosures. Have counsel confirm which statutes apply.]
Cookies
Owner input required: cookie disclosure
[OWNER TO CONFIRM: cookie usage. If the site sets no cookies beyond what is strictly required to function, state: "This site does not use advertising, tracking or profiling cookies. We use only cookies strictly necessary for the site to function." If any analytics or marketing cookie is added later, this section and a consent mechanism must be updated.]
Children
This site is intended for business owners and is not directed to anyone under 18. We do not knowingly collect information from children. If you believe a child has sent us information, email info@themcarescue.com and we will delete it.
Links to other sites
Our site may link to other websites, including a scheduling tool and government filing search resources. We don't control those sites and this policy doesn't cover them. Read their policies before giving them information.
Changes to this policy
We may update this policy as our practices or the law change. When we do, we'll change the "last updated" date at the top, and for material changes we'll make a reasonable effort to notify clients directly. Continuing to use the site after an update means you accept the revised policy.
